Terms of Service

POLAR ANTICHEAT SOFTWARE (hereinafter referred to as "Polar", "Polar Software", "we" or "us") is a software product provided on an "as is" basis and without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not assume any liability for any damages or claims arising from the use of the software, including but not limited to any claims for lost profits, lost data, or business interruption.

0. License and Usage

To use Polar Software, users must obtain a valid license through our website and maintain the license in good standing throughout the use of the software. Users are not permitted to redistribute, disassemble, decompile, or otherwise tamper with the software, except for purposes related to cheat detection and prevention.

1. User Information and Usage Limits

By using Polar Software, users confirm that all information provided to us is true, accurate, current, and complete. The software can only be used within the limits of the paid subscription and within the server environment for which the license was purchased.

2. Age Requirements and Identity Verification

Users must have the legal capacity to enter into a binding contract and must be at least 16 years of age to use Polar Software. We reserve the right to request valid proof of identity and to use Stripe Identity technology to verify user identity to prevent software piracy, illegal distribution, and contract breaches. Failure to comply with these requirements may result in the immediate termination of the license agreement.

3. Subscription and System Requirements

The purchase of a Polar license involves a recurring subscription that can be canceled no later than 24 hours before the beginning of the next billing period.

Polar Software has specific hardware requirements:

  • AMD64 CPU
  • Minimum of 2 cores/4 threads
  • No less than 60MB RAM/player
  • No less than 4GB RAM overall
  • Active, uninterrupted internet connection

4. Data Collection

We may collect certain data to improve our services, prevent piracy, and analyze software metrics, including access logs, anticheat logs, information related to player activity, software installed within the server environment, anonymized data for statistical analysis, hardware information, IP addresses of the servers using Polar software, and any software "exception"/"panic" occurred within the server environment.

5. Hardware Identification and License Termination

Polar uniquely identifies a dedicated server by its Hardware ID, which may consist of Motherboard, Hard Drive, Network, and any other hardware information. We reserve the right to immediately terminate any user's license and stop any user's subscription for the next billing period if there is reasonable suspicion of a breach of our terms of service.

6. Pricing and Terms Changes

We reserve the right to change the pricing of our services at any time, without prior notification. Any changes to the terms of service will be effective immediately upon publication. Public disclosure of limited access information is prohibited.

7. Refunds and License Usage

Refunds for the first billable period of the subscription are not provided, but users may request a refund if they forget to cancel the subscription. Plan upgrades are refundable within 48 hours after the upgrade. Each licensed copy of Polar Software may be used by a single project owned by a single company. A copy of Polar may be distributed to contractors with documentary proof of contractual relations.

8. License Accountability

Users are held accountable for any breach of the terms of service, including accidental or third-party breaches, if the license copy involved is owned by the user. One entity may purchase and use one Polar license only, and if a server requires an increase in plan limits beyond the offered options, an enterprise plan must be applied for.

9. Fair Use Policy

Polar enforces a Fair Use Policy to limit the number of server instances and players processed through Polar SaaS backend as a result of the use of Polar software. We may limit the number of server instances available to a user if we believe that the number of servers run by a user is excessive or unreliable.

10. License Suspension and Termination

Polar may request more information, and terminate or temporarily suspend a user's Polar license if:

  • there's reason to believe that You, the Customer, are engaged in illegal, fraudulent or dishonest activity;
  • you are advocating for, producing, developing, selling, distributing or repeatedly using software targeted towards bypassing cheat prevention technology, and/or gaining unfair advantage in an online game environment;
  • you are advocating for, conducting, participating in software piracy;
  • you are distributing, advertising or producing illegal copies of Polar software;
  • you are providing false, inaccurate or incomplete information about yourself or your server;
  • you breach any term of this agreement or any related policy;
  • we reasonably believe that your server is used for activities that pose a security threat to Polar's servers or other servers;
  • or giving us strong reason to believe you do any of the above.

We are not liable for any damages or losses resulting from the modification, suspension, or discontinuation of our services.

11. Technical Support

Polar may provide technical support to its customers, but this support is not guaranteed and may be subject to additional fees. We may also limit or refuse support if we believe that the customer is engaged in any activity that violates our terms of service or is detrimental to our software or servers.

12. Law Enforcement Cooperation

Polar may cooperate with law enforcement agencies or other third parties to investigate and prosecute any illegal or fraudulent activity related to the use of our software. We may also disclose user information if required by law or court order.

13. User Conduct

Users may not use Polar software to harass, defame, or discriminate against any individual or group. We reserve the right to suspend or terminate the license of any user who engages in such behavior.

14. Future Features

Polar may provide additional features or services in the future, which may be subject to additional fees or terms of service. Users will be notified of any such changes in advance.

15. Software Updates

Polar Software reserves the right to modify or update the software at any time, without prior notice, to improve its performance, security, or to add new features. The user acknowledges that such modifications or updates may affect the compatibility of the software with the server environment or third-party software and that it is their responsibility to ensure compatibility.

16. Detection Limitations

The user acknowledges that the software relies on detection mechanisms that are not infallible and that there is no guarantee that all cheats will be detected. Polar Software shall not be held liable for any damages resulting from the failure of the software to detect cheating.

17. Indemnification

The user agrees to indemnify and hold Polar Software, its affiliates, officers, agents, and employees harmless from and against any and all claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from the user's use of the software, breach of this agreement, or violation of any applicable law or regulation.

18. Agreement Structure

The headings and captions used in this agreement are for convenience only and do not limit or affect the interpretation of this agreement. This agreement constitutes the entire agreement between the parties and supersedes all prior agreements and understandings, whether written or oral, relating to the subject matter of this agreement.

19. Proof of Residence

We reserve the right to request proof of residence in a specific country if a user uses a credit card issued in that country. This is to prevent fraudulent use of foreign credit cards, particularly from users located in high-risk countries. If a user fails to provide proof of residence, we may terminate or suspend their license without notice.

20. Documentation Acknowledgment

The user asserts that they have read and understood all the information available on how Polar works, including its incompatibilities and configurability as outlined in our documentation available at https://docs.polar.top

21. Information Updates

The user must promptly inform Polar of any changes to their information or company structure or of any other details provided to Polar during the onboarding process.

22. IP Access Restrictions

Polar reserves the right to restrict access from IP addresses originating from sanctioned countries, or listed in spam databases, or IP addresses involved in misuse, to connect to Polar infrastructure, including the cloud instances, rendering the anticheat software inoperative.
